Terms of Service

1. Acceptance of Terms

By accessing or using TroutFishing ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

TroutFishing provides AI-powered trout fishing forecasts, including weather data, water conditions, hatch predictions, and fly recommendations. The Service is intended for informational and recreational purposes only.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use

4. Subscription and Payment

4.1 Pricing

TroutFishing offers a free tier and paid Pro subscription. Current pricing is:

  • Free: $0 - Basic features with limited forecasts
  • Pro Monthly: $6 per month
  • Pro Annual: $40 per year ($3.33/month equivalent)

4.2 Digital Service - No Refunds

TroutFishing is a digital service. All sales are final and no refunds will be provided. By subscribing to a paid plan, you acknowledge and agree that:

  • You are purchasing access to a digital service
  • Refunds are not available for any reason, including but not limited to dissatisfaction with the service, failure to use the service, or change of mind
  • This no-refund policy applies to both monthly and annual subscriptions

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period
  • You will retain full access to Pro features until your subscription expires
  • No partial refunds will be provided for unused time
  • After expiration, your account will revert to the free tier

4.4 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the subscription fees.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service
  • Scrape, harvest, or collect data without permission
  • Redistribute, resell, or sublicense the Service
  • Use the Service to compete with TroutFishing

6. Intellectual Property

All content, features, and functionality of TroutFishing, including but not limited to algorithms, text, graphics, logos, and software, are owned by TroutFishing and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written permission.

7. Third-Party Services

TroutFishing integrates with third-party services including:

  • Weather data from Open-Meteo
  • Water data from USGS (United States Geological Survey)
  • Authentication by Clerk
  • Payment processing by Stripe

Your use of these services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that:

  • Forecasts will be accurate or reliable
  • The Service will be uninterrupted or error-free
  • Fishing conditions will match predictions

Fishing involves inherent risks. Always exercise caution, check local conditions, follow fishing regulations, and prioritize your safety.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TROUTFISHING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TroutFishing from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or through the Service.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
